1. Introduction
This document constitutes the Terms and Conditions (hereinafter referred to as “Terms”) of G-D Trade LLC (a company registered under the laws of Georgia, with identification number: 405372608) (hereinafter referred to as “Us” or “We” or “GeoCom”).
These Terms govern the use of Our Website: www.Geocom.ge (hereinafter the “Website”) and the rental of Our portable hotspot Devices by the users (hereinafter “You” or “Custmer”). By accessing Our Website and renting Our Devices, You agree to be bound by these Terms. Please read them carefully before using Our services.
2. Definitions
Device: Refers to the portable hotspot Device rented from GeoCom.
Customer: Refers to the individual or entity renting the Device from GeoCom.
Deposit: A refundable amount paid by the Customer in advance to cover potential damages or loss of the Device.
Rental Period: The duration for which the Customer rents the Device, starting from the date of dispatch until the date of return.
Agreement: Refers to the rental contract between GeoCom and the Customer, comprising these Terms.
Business Locations: The physical locations operated by GeoCom where Customers can rent and return Devices.
Business Partners: Authorized third-party locations where Customers can rent and return Devices.
Service(s): provision of hotspot through the Device and other services that We might offer from time to time.
3. Renting the Device
3.1 Rental Fees and Deposit
3.1.1 The Customer agrees to pay the rental fees and a Deposit as specified at the time of renting the Device.
3.1.2 The rental fee covers the use of the Device for the specified Rental Period and includes applicable taxes, unless stated otherwise.
3.1.3 The Deposit amount is determined based on the Device model and rental duration and is communicated to the Customer prior to payment.
3.2 Payment Terms
3.2.1 All payments must be made in advance through the payment methods available on Our Website.
3.2.2 The rental fee and Deposit must be paid in full before the Device is provided to the Customer
4. Device Delivery and Return
4.1 Delivery
4.1.1 Devices can only be rented and picked up at GeoCom’s Business Locations or through Our authorized Business Partners, the list of which you can see on the Website.
4.1.2 GeoCom or its Business Partners will provide instructions for the proper use and care of the Device at the time of rental.
4.2 Return
4.2.1 The Customer is responsible for returning the Device to one of GeoCom’s Business Locations or authorized business partner locations no later than on the last day of the Rental Period.
4.2.2 Returns can be made during the business hours of the respective Business Location. Customers should check the operating hours of the specific Business Location to ensure timely return.
4.2.3 Late returns will incur additional charges in the amount of 5 Lari for each day of overdue return, which will be deducted from the Deposit.
4.2.4 Customers must return the Device in the same condition as it was received, subject to reasonable wear and tear.
5. Deposit Policy
5.1 Deposit Retention
5.1.1 The Deposit will be held by GeoCom for the duration of the Rental Period and is intended to cover any potential damages or loss of the Device.
5.1.2 GeoCom reserves the right to retain the Deposit, in whole or in part, in the event of:
5.1.2.1 Damage to the Device beyond normal wear and tear.
5.1.2.2 Loss or theft of the Device.
5.1.2.3 Late return of the Device, resulting in additional rental charges.
5.2 Deposit Refund
5.2.1 The Deposit will be refunded to the Customer within 7-14 business days after the Device is returned in the condition determined in these Terms.
5.2.2 If any deductions are made from the Deposit, GeoCom will provide a detailed breakdown of the charges to the Customer.
6. Device Usage
6.1 Proper Use
6.1.1 The Customer agrees to use the Device in accordance with the provided instructions and for lawful purposes only.
6.1.2 The Device must not be used in any manner that could damage, disable, overburden, or impair its functionality.
6.2 Prohibited Actions
6.2.1 The Customer is not entitled to:
6.2.2.1 Modify, tamper with, or attempt to repair the Device.
6.2.2.2 Use the Device to engage in illegal activities.
6.2.2.3 Share the Device with third parties without GeoCom’s consent.
6.3 Customer Responsibilities
6.3.1 The Customer is responsible for:
6.3.2 Safeguarding the Device against damage, loss, or theft.
6.3.3 Reporting any issues with the Device to GeoCom immediately.
7. Liability and Indemnity
7.1 GeoCom’s Liability
7.1.1 GeoCom is not liable for:
7.1.1.1 Any indirect, incidental, or consequential damages arising from the use of the Device.
7.1.1.2 Interruptions in service due to network issues or other factors beyond Our control.
7.1.1.3 Any data loss or damage to the Customer’s equipment resulting from the use of the Device.
7.2 Customer Indemnity
7.2.1 The Customer agrees to indemnify and hold GeoCom harmless from any claims, damages, losses, or expenses arising from the Customer’s use of the Device or breach of these Terms.
8. Termination
8.1 Termination by GeoCom
8.1.1 GeoCom reserves the right to terminate the rental agreement and reclaim the Device if the Customer breaches any of these Terms or engages in prohibited actions.
8.2 Termination by Customer
8.2.1 The Customer may terminate the rental agreement by returning the Device before the end of the Rental Period. Early termination may not result in a refund of the rental fee.
9. Amendments
9.1 GeoCom reserves the right to amend these Terms at any time. Any changes will be posted on Our Website and will be effective immediately upon posting. Customers are encouraged to review these Terms periodically.
10. Governing Law
10.1 These Terms are governed by and construed in accordance with the laws of Georgia Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Georgia.
